Terms of Use
Last updated 26 October 2026
1. Who these terms are with
DigsFact, Inc., 8 The Green, Ste B, Dover, DE 19901, USA ("DigsFact", "we"). By using this site, calling or texting one of our demo lines, signing up, or using the service, you agree to these terms. If you are agreeing on behalf of a company, you confirm you are allowed to.
2. What the service does
You forward calls your business does not answer to a number we provide. When a call comes through unanswered, the agent sends the caller a text, asks a few questions, and sends you a summary. It reads voicemails, looks at photos the caller sends, and replies in the caller's language. Your own phone number, handset and voicemail are unchanged.
The agent is software. It is not a person, it does not give professional advice, and it does not quote prices or make commitments on your behalf. If a caller asks whether they are talking to a person, it says plainly that it is an AI assistant.
3. Demo lines
The numbers on this site are demonstrations and are meant to be tried. Do not send them real customer information, account numbers, card numbers or anything else sensitive. Conversations on demo lines may be reviewed to improve the agent. We may limit or withdraw access to the demo lines at any time. Trial lines started before 26 October 2026 run until their trial ends and are then released unless you ask to keep them.
4. What you are responsible for
- The right to use the number. You must own or control the phone line you ask us to cover.
- Lawful messaging. The agent replies to people who called you, which is why it works the way it does. You are responsible for complying with the laws and carrier rules that apply to your messages, including the Telephone Consumer Protection Act, state equivalents, and the carrier registration requirements for business messaging in the United States. Do not use the service to send marketing to people who have not asked for it.
- Honest information. The business name and details you give us are shown to your callers, so they must be accurate.
- Your own obligations to your callers. Once a lead summary reaches you, what you do with it is governed by your privacy practices, not ours.
5. What you may not do
Do not use the service to deceive people about who they are dealing with, to send unlawful, harassing or fraudulent messages, to impersonate another business, to work around STOP requests, to test or attack the system's security, or to resell the service without our written agreement.
6. Messages and rates
Message frequency varies with how many calls you miss. Message and data rates may apply to you and to your callers, charged by their own carriers. Callers can stop messages at any time by replying STOP, and we will not re-engage a number that has opted out.
7. Pricing and cancellation
Installation is free, and the first 30 days are free. To start, you put a card on file through our payment provider, Stripe; nothing is charged that day. Your first payment of $299 for a single covered line is taken 30 days after you sign up, and then every month on the same date. If you cancel before the 30 days are up, you pay nothing. There is no contract and no cancellation fee: you can cancel at any time from your admin page or by emailing info@digsfact.com, and we will not bill you for any month after you cancel. If you start signing up but do not finish adding a card, the number we held for you is released after 24 hours. If you sign up through a plan page we sent you, such as our commercial plan, the prices shown on that page apply instead, including the price of any extra lines. Teams, multiple lines and higher call volumes are otherwise priced separately by written agreement. Prices may change with 30 days' notice, and any change applies from your next billing period.
8. No guarantee of results
We do not promise a particular number of leads, replies or recovered jobs. The service depends on telephone carriers, third-party providers and the behaviour of your callers, and it will sometimes be unavailable or make mistakes. The agent's summaries are generated by an AI model and may contain errors; do not rely on them as a complete record of what a caller said. The service is provided "as is" and, to the extent the law allows, without warranties of any kind, including fitness for a particular purpose.
9. Limits on liability
To the extent the law allows, DigsFact is not liable for lost profits, lost business, lost leads, or indirect or consequential damages. Our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.
10. Suspension and termination
Either of us may end the service at any time. We may suspend it immediately if it is being used unlawfully, if a carrier requires it, or if non-payment continues after we have asked. On termination we release the numbers we provisioned for you and delete the data on the schedule in the Privacy Policy.
11. Our materials
The software, this site, and the DigsFact name and logo belong to us. The content of your conversations and your customer information belong to you. You grant us only the permission needed to run the service for you.
12. Privacy
How we handle information is described in the Privacy Policy, which forms part of these terms.
13. Changes
We may update these terms. The date at the top shows when they last changed, and if a change materially affects a paying customer we will give notice before it takes effect.
14. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction over any dispute.
